I’ve actually read the TPP text and I’ve given the president an earful about how this trade deal will damage this nation. But I can’t share my criticisms with you. Anyone who has read the text of the agreement could be jailed for disclosing its contents.

Of course it is not "certain" what the effects of TPP will be, just as it is not "certain" that shooting someone at close range will lead to their death.
Under a similar existing clause, a French company sued Egypt because Egypt raised its minimum wage and a Swedish company sued Germany because Germany decided to phase out nuclear power after Japan's Fukushima disaster.

The TPP is the largest—and worst—trade deal you’ve never heard of, devised in secret by representatives of some of the world’s largest corporations.
The TPP is a Trojan horse in a global race to the bottom, giving big corporations and Wall Street banks a way to eliminate any and all laws and regulations that get in the way of their profits.
“It is incomprehensible to me that the leaders of major corporate interests are actively involved in the writing of the TPP while elected officials have little or no knowledge as to what is in it.”
